1. Who we are
The Black Basket PTY LTD ("Black Basket Travel", "we", "us") is a registered travel curator. By accessing or using blackbaskettravel.com (the "Site") you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. Your use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. You will not transmit malicious code, attempt unauthorised access, scrape content at scale, or impersonate any person or entity.
3. Bookings, quotes & supplier role
All itineraries, prices, departure dates, and inclusions on the Site are illustrative and subject to availability, FX movements, supplier confirmation, and seasonal pricing. We act as an agent between you and third-party suppliers (airlines, hotels, ground operators, insurers). The contract for each travel service is between you and the relevant supplier on their booking terms.
4. Payments & deposits
Bookings are confirmed on receipt of the deposit reflected on your booking confirmation. Balance payments are due as detailed on each itinerary. We reserve the right to release a booking if balances are not received by the published due date.
5. Cancellations & changes
Cancellation, refund, and amendment terms vary by supplier and fare class. They are presented to you in writing before booking confirmation and form part of your contract. Travel insurance is strongly recommended.
6. Currency & pricing
Prices are stored in USD and converted to your selected display currency in real time using mid-market rates from public FX feeds. Rates shown are indicative — the final invoiced price is the supplier's confirmed amount in the contract currency at time of booking.
7. Participation, assumption of risk & indemnity
Tours, excursions, activities and adventures organised by Black Basket Travel and/or its partners may involve inherent risks — including travel by vehicle, flight, boat or other transport; outdoor, nature-based or adventure activities; physical exertion; adverse weather or natural events; and interaction with wildlife, terrain, and unfamiliar environments. These risks may result in personal injury, illness, death, or loss of or damage to property. By booking, you voluntarily and knowingly assume all such risks and you indemnify, hold harmless, and release The Black Basket PTY LTD, its owners, directors, employees, guides, contractors and agents from any and all claims — whether for personal injury, death, property loss or damage, or financial loss — arising directly or indirectly from your participation in any tour or activity, to the maximum extent permitted by law. A signed indemnity may be required before travel; the indemnity form is available in the Site footer.
8. Medical fitness, insurance & emergencies
You confirm that you are medically fit to participate in the activities you select, and that you have disclosed any medical conditions, allergies, disabilities, or special needs relevant to your trip. You accept responsibility for your own medical costs. We may arrange emergency medical assistance where reasonably possible, but assume no responsibility for medical outcomes or costs. Black Basket Travel does not provide personal travel insurance; we may present cover options, but it remains your responsibility to ensure you are adequately insured.
9. Photography, media & marketing consent
Unless you notify us in writing otherwise, you grant Black Basket Travel permission to use photographs and video recordings taken during activities and trips for marketing, promotional, and social-media purposes. You may withdraw this consent at any time by emailing us, after which we will stop using newly captured media of you.
10. Electronic acceptance & signatures
Where you complete an online form, tick a confirmation box, or submit an indemnity through the Site, you agree that this constitutes your electronic signature and consent under the Electronic Communications and Transactions Act 25 of 2002, and is as legally binding as a handwritten signature. We record the date of each submission.
11. Intellectual property
All content on the Site — including copy, logos, photography, itineraries, video, and code — is owned by or licensed to The Black Basket PTY LTD and is protected by South African and international copyright laws. You may not copy, redistribute, or reuse content without prior written permission.
12. Limitation of liability
To the maximum extent permitted by law, Black Basket Travel is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising from your use of the Site or any travel arrangements made through it. Our aggregate liability shall not exceed the service fee you paid to us in the 12 months preceding the claim.
13. Third-party links & content
The Site may include links to third-party websites or services. We do not endorse, control, or accept responsibility for the content of those sites.
14. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be submitted to the exclusive jurisdiction of the South African courts, save where mandatory consumer-protection law gives you a different forum.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance.
